General Terms and Conditions
Contract terms and legal information from subtel GmbH.
1 – Scope and Definitions
1.1 These General Terms and Conditions (GTC) apply to all contracts concluded via www.subtel.ch between subtel GmbH (hereinafter “Provider”) and the consumer (hereinafter “Customer”).
1.2 A consumer within the meaning of these GTC is any natural person who orders goods from us for a purpose that is predominantly neither commercial nor professional in nature (see Art. 32 ZPO, Art. 120 IPRG).
1.3 The Provider is subtel GmbH, Mainzer Str. 3, 10247 Berlin, Germany, which delivers goods to Switzerland via www.subtel.ch as part of its commercial activities.
2 – Prices and Payment
2.1 All prices are quoted in Swiss francs (CHF) and include the applicable Swiss value-added tax as well as the advance disposal fee (vRG). Shipping costs are shown separately (Price Indication Ordinance, PBV).
2.2 The accepted payment methods are displayed during the ordering process.
3 – Conclusion of Contract
3.1 The product descriptions in the online shop do not constitute legally binding offers, but rather an invitation to the customer to submit a binding offer.
3.2 By submitting the order, the customer makes a binding offer. Receipt of the order is confirmed electronically without delay; this confirmation does not yet constitute acceptance of the contractual offer. The contract is concluded upon receipt of a separate order confirmation or, at the latest, upon shipment of the goods.
3.3 Before placing a binding order, the customer has the opportunity to review their entries and correct any input errors (Art. 3(1)(s) UWG).
4 – Delivery and Delivery Area
4.1 Delivery is made exclusively to addresses in Switzerland. As an EU shipper, subtel handles customs and import tax clearance (DDP — Delivered Duty Paid), unless otherwise indicated during the ordering process.
4.2 Delivery times are specified during the ordering process and on the product page.
5 – Voluntary 30-Day Return Policy
5.1 For deliveries to consumers residing in Switzerland, Swiss law does not provide for any statutory right of withdrawal or return in respect of contracts concluded by distance communication (in particular via the online shop); Art. 40a–40g of the Swiss Code of Obligations (OR) apply exclusively to door-to-door sales and comparable contract-conclusion situations (Art. 40b OR) and, in any event, only to contracts where the customer's performance exceeds CHF 100 (Art. 40a para. 1 lit. b OR).
5.2 However, we voluntarily grant you a contractual right of return for 30 days from receipt of the goods, exceeding the statutory requirements. Within this period, you may return the goods to us without providing a reason. The goods must be returned unused, in their original packaging, and with undamaged labels and seals.
5.3 This voluntary right of return does not affect the statutory rights regarding defects under Art. 197 et seq. of the Swiss Code of Obligations (OR).
6 – Retention of Title
The goods remain the property of subtel GmbH until the purchase price has been paid in full (Art. 715 et seq. of the Swiss Civil Code (ZGB) in conjunction with Art. 184 of the Swiss Code of Obligations (OR)).
7 – Vouchers from Promotions
Vouchers that we issue as part of promotional campaigns without consideration are valid only for a limited period and are not redeemable for cash. The terms and conditions are specified on the respective voucher.
8 – Warranty for Defects
8.1 The statutory provisions on liability for defects pursuant to Art. 197 et seq. of the Swiss Code of Obligations (CO) apply.
8.2 In the event of defects, you are entitled to rescission, reduction, or replacement in accordance with Art. 205 and Art. 206 CO.
8.3 The statute of limitations for claims for defects is two years from delivery for new goods (Art. 210(1) CO). This period is mandatory for consumer purchases and cannot be shortened by these Terms and Conditions (Art. 210(4) CO).
8.4 Defects must be reported in writing immediately upon discovery (Art. 201 CO).
8.5 In addition to the statutory liability for defects, we provide a voluntary 3-year warranty on all products, which does not affect the purchaser’s statutory rights. The exact terms are set forth in our warranty conditions.
9 – Limits of Our Liability
Subtel is liable for slight negligence only in the event of a breach of material contractual obligations (cardinal obligations). In this case, liability is limited to foreseeable damage typical for this type of contract. Liability for intent, gross negligence, damages resulting from injury to life, limb, or health, as well as under mandatory statutory provisions (e.g., Product Liability Act, PrHG) remains unaffected.
10 – Governing Law and Jurisdiction
10.1 For contracts with consumers having their habitual residence in Switzerland, Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws referral provisions (Art. 120 IPRG).
10.2 The place of jurisdiction for claims by the consumer is, at the consumer’s discretion, either the provider’s registered office or the consumer’s place of residence in Switzerland (Art. 32(1)(a) ZPO). For claims brought by the Provider, the exclusive jurisdiction lies with the place of residence of the defendant consumer (Art. 32(1)(b) ZPO).
11 – Out-of-Court Dispute Resolution
11.1 There is no legal obligation for subtel GmbH in Switzerland to participate in a dispute resolution procedure. We always strive to resolve complaints amicably.
11.2 Consumers in Switzerland may contact the E-Commerce Ombudsman’s Office in the event of disputes: E-Commerce Ombudsman’s Office, c/o Konsumentenforum kf, Belpstrasse 11, 3007 Bern, konsum.ch. Participation in proceedings before the Ombudsman’s Office is voluntary.
12 – Return of Electrical Appliances and Batteries (VREG)
12.1 Under Swiss law, electrical and electronic devices as well as batteries may not be disposed of with household waste (Ordinance on the Return, Take-Back, and Disposal of Electrical and Electronic Equipment, VREG).
12.2 You can return old devices and used batteries free of charge at any retail location that sells such devices or batteries, as well as at official collection points (e.g., SENS eRecycling, INOBAT). Upon request, we will also take back old devices and batteries free of charge. Please contact our customer service for this purpose.
